1. Acceptance of Terms
By registering, installing, accessing, or using the Nityam AI - Grow your business software, web applications, or mobile applications (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you represent an organization or business, you warrant that you possess the authority to bind such entity to these Terms.
2. Description of Services & Meta Integration
Nityam AI is an autonomous, artificial intelligence-powered marketing workflow platform designed to assist businesses, brands, and creators with:
- Generating 9:16 kinetic marketing reels and promotional carousel assets from product catalogs and service offerings.
- Automating daily content calendar scheduling.
- Publishing approved media containers directly to verified Instagram Business accounts using official Meta Graph API endpoints.
- Displaying audience performance insights and engagement analytics.
Meta Platform Compliance: Your usage of our Instagram integration features is additionally subject to Meta's Commercial Terms, Platform Terms, and Instagram Community Guidelines. Users must not attempt to use Nityam AI to bypass Instagram rate limits or post restricted or harmful material.
3. User Accounts & Instagram Authentication
To use publishing features, you must authenticate through Meta OAuth 2.0. You agree that:
- You will only connect Instagram accounts that you legitimately own or are authorized to manage as an administrator.
- You are responsible for maintaining the confidentiality of your credentials.
- You will not use the platform for unauthorized spamming, copyright infringement, or deceptive marketing schemes.
4. Intellectual Property & Content Ownership
You retain 100% full legal ownership of all assets, product images, brand trademarks, copy, and videos generated using Nityam AI. By using the platform to generate and publish content, you grant Nityam AI a worldwide, non-exclusive, royalty-free license solely to host, render, format, and transmit your media containers to Meta Graph API for publishing purposes.
5. Prohibited Conduct
You agree not to use Nityam AI to create or publish content that:
- Violates any applicable federal, state, local, or international law.
- Infringes on third-party intellectual property rights or unauthorized brand trademarks.
- Promotes illegal goods, regulated drugs, adult services, hate speech, or harassment.
- Interferes with or disrupts the security or stability of Meta Graph API servers or Nityam AI networks.
6. Termination
You may terminate your agreement with Nityam AI at any time by disconnecting your Instagram account and deleting your profile. We reserve the right to suspend or terminate accounts that breach these Terms or Meta Platform Terms.
